Welcome to Coastal Crunch Kettle Corn. These Terms of Service ("Terms") govern your use of the Coastal Crunch Kettle Corn website, located at coastalcrunchkettlecorn.com, and all purchases made through this website. By accessing or using our website, you agree to be bound by these Terms.
1. General Conditions and Acceptance of Terms
By placing an order through our website, you warrant that you are legally capable of entering into binding contracts. We reserve the right to refuse service to anyone for any reason at any time.
2. Product Information and Disclaimers (Food Specific)
A. Ingredients and Allergy Disclaimer
We strive to be as accurate as possible in the product descriptions and ingredient lists provided on the site. However, all customers are responsible for reviewing ingredient information prior to purchasing to avoid allergic reactions.
Nut-Free Facility: We state that our facility is Nut-Free. We take reasonable steps to maintain this, but we make no guarantee that products have zero contact with allergens in the broader supply chain.
Perishable Goods: Kettle corn is a perishable food item. We are not responsible for product degradation that occurs due to weather, improper storage after delivery, or delays caused by the customer (e.g., failure to retrieve package promptly).
B. Product Appearance
While we attempt to ensure the colors, packaging, and sizing of products are displayed accurately, the actual product you receive may vary slightly due to monitor displays or minor packaging updates.
3. Pricing and Payment
A. Pricing
All prices listed are in U.S. Dollars (USD). Prices for our products are subject to change without notice. We reserve the right to modify or discontinue products at any time without notice.
B. Payment
We accept various forms of payment as displayed at checkout. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
C. Tax
You are responsible for any applicable sales tax, duties, or government charges associated with your order.
4. Order Fulfillment, Shipping, and Delivery
A. Order Acceptance
Your receipt of an electronic order confirmation does not signify our final acceptance of your order. We reserve the right at any time after receiving your order to accept or decline it for any reason.
B. Fulfillment Policy (Batch Shipping)
For Fundraiser and Group Orders: All kettle corn products purchased during a designated fundraiser period will be popped and shipped together after the fundraiser concludes.
Timeline: We will ship the bulk of all orders approximately 2 business days after the stated fundraiser end date.
Shipping Method: All non-local orders are shipped via USPS Priority Mail or an equivalent carrier. Shipping costs are non-refundable and are calculated separately from product revenue.
Delivery Time: Delivery times are estimates only and begin from the date of shipment, not the date of order. We are not responsible for delivery delays once the package is transferred to the carrier.
C. Shipping Address Accuracy
The customer is responsible for providing the correct shipping address. Orders shipped to an incorrect address provided by the customer are not eligible for refunds or free reshipment.
5. Returns, Refunds, and Cancellations
A. Refunds/Exchanges (No Returns)
Due to the perishable nature of our product, all sales are final. We do not accept returns or exchanges.
B. Damaged or Incorrect Orders
If your order arrives damaged, incorrect, or incomplete, you must notify Coastal Crunch Kettle Corn within 48 hours of receiving the order. We require photographic proof of damage to the product and packaging to process a replacement or a refund for the damaged portion.
C. Order Cancellation
Orders may be canceled only if a request is received within 2 hours of the order being placed, provided the order has not yet entered the processing or popping stage.
6. Limitation of Liability
Coastal Crunch Kettle Corn, its owners, and its employees shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from the use of, or inability to use, our products or services. Our maximum liability to you for any claim arising from your purchase is limited to the amount paid by you for the product in question.
7. Governing Law
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
